AN ACT
Amending Title 35 (Health and Safety) of the Pennsylvania
Consolidated Statutes, in COVID-19 disaster emergency,
providing for increased pricing notification to consumers.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Chapter 57 of Title 35 of the Pennsylvania
Consolidated Statutes is amended by adding a subchapter to read:

INCREASED PRICING NOTIFICATION TO CONSUMERS

5751. Notification requirements.
ยง 5751. Notification requirements.
(a) General rule.--Notwithstanding any other provision of
law, during the COVID-19 disaster emergency, a business
operating in this Commonwealth which provides consumer goods and
services shall notify consumers if the price of a consumer good
or service has increased by 10% or more since the issuance of
the COVID-19 disaster emergency.

(b) Requirements.--Notification shall occur at the point of
sale and be presented in a conspicuous and prominent place. The
notification shall include the price of the good or service
prior to the issuance of the COVID-19 disaster emergency, the
current price of the good or service and the percentage of
increase during that time.
(c) Online purchases.--For online purchases, a consumer
shall be notified of the price increase as provided under
subsection (b) prior to the completion of the sale transaction.
(d) Justification.--A business may provide justification for
the price increase when the price increase is beyond the control
of the business.
Section 2. This act shall take effect in 60 days.
