AN ACT
Amending Title 24 (Education) of the Pennsylvania Consolidated
Statutes, in membership, contributions and benefits, further
providing for termination of annuities.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 8346 of Title 24 of the Pennsylvania
Consolidated Statutes is amended by adding a subsection to read:
ยง 8346. Termination of annuities.

(b.3) Return to school service in a substitute teacher
position.--
(1) An annuitant may be returned to school service in a
substitute position, long term or day-to-day, for a period
not to exceed 90 days in any school year, without loss of the
individual's annuity. In computing the number of days an
annuitant has returned to school service, any amount of time
less than one-half of a day shall be counted as one-half of a

day.
(2) The annuitant shall not be entitled to earn credited
service, and no contributions may be made by the annuitant,
the employer or the Commonwealth on account of the
employment.
(3) For purposes of this subsection, the term
"substitute" shall mean an individual who has been employed
to perform the duties of a regular professional employee
during the period of time that the regular professional
employee is absent on sabbatical leave or for other legal
cause authorized and approved by the board of school
directors or to perform the duties of a temporary
professional employee who is absent.

Section 2. This act shall take effect in 60 days.
