AN ACT
Amending Title 66 (Public Utilities) of the Pennsylvania
Consolidated Statutes, in rates and distribution systems,
further providing for rates to be just and reasonable.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 1301 of Title 66 of the Pennsylvania
Consolidated Statutes is amended by adding a subsection to read:
ยง 1301. Rates to be just and reasonable.

(c) COVID-19 limitation.--
(1) Notwithstanding any other law, rule, regulation or
order of the commission, a public utility may not increase a
rate to recover lost revenue if the lost revenue is
attributable to COVID-19 or COVID-19-related mitigation
measures, including those within the scope of the order
issued by the Governor on March 19, 2020, to limit the
operation of non-life-sustaining businesses.
(2) For purposes of this subsection, the term "COVID-19"

means the coronavirus disease 2019, an infectious disease
caused by severe acute respiratory syndrome coronavirus 2
that was first identified during December 2019 in Wuhan,
China.
Section 2. This act shall take effect immediately.
