AN ACT
Amending Title 53 (Municipalities Generally) of the Pennsylvania
Consolidated Statutes, in general provisions relating to home
rule and optional plan government, further providing for
limitation on municipal powers.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 2962(a)(1) of Title 53 of the
Pennsylvania Consolidated Statutes is amended to read:
ยง 2962. Limitation on municipal powers.
(a) Powers granted by statute.--With respect to the
following subjects, the home rule charter shall not give any
power or authority to the municipality contrary to or in
limitation or enlargement of powers granted by statutes which
are applicable to a class or classes of municipalities:
(1) [The] Except as provided in this paragraph, the
filing and collection of municipal tax claims or liens and
the sale of real or personal property in satisfaction of
them. A city of the third class that has adopted a home rule
charter and is located in a county of the second class may,

by ordinance, provide alternative procedures for the
collection of a municipal tax claim or lien and the sale of
real property in satisfaction of the claim or lien in any
manner consistent with the Constitution of Pennsylvania and
not prohibited by the home rule charter of the city of the
third class. No ordinance adopted under this paragraph shall
be effective until approved by resolution of all taxing
districts, as defined in section 8802 (relating to
definitions), levying property taxes within the city of the
third class other than the city of the third class that
enacted the ordinance. Upon the effective date of the
ordinance, the city of the third class shall not be subject
to any duties under those laws applicable to a city of the
third class for the filing and collection of a municipal tax
claim or lien and the sale of real property in satisfaction
of the claim or lien.
