AN ACT
Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
act relating to the public school system, including certain
provisions applicable as well to private and parochial
schools; amending, revising, consolidating and changing the
laws relating thereto," in reimbursements by Commonwealth and
between school districts, further providing for State
reimbursement for health services.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 2505.1(b.1) of the act of March 10, 1949
(P.L.30, No.14), known as the Public School Code of 1949, is
amended and the section is amended by adding subsections to
read:
Section 2505.1. State Reimbursement for Health Services.--*

(b.1) Every school district which renders health services to
children shall be reimbursed by the Commonwealth on account of
health services which conform to standards approved by the
Secretary of Health. Reimbursement shall be paid by the
Secretary of Health. For the school year 1990-1991, the amount

of this reimbursement for this subsection shall be the sum of
five dollars and ninety cents ($5.90) multiplied by the average
daily membership of each school district. For the school year
1991-1992 and each school year thereafter, the amount of this
reimbursement for this subsection shall be the sum of nine
dollars and seventy cents ($9.70) multiplied by the average
daily membership of each school district. For the school year
2022-2023 and each school year thereafter, the amount of this
reimbursement for this subsection shall be the sum of the
following:
(1) Nine dollars and seventy cents ($9.70) multiplied by the
average daily membership of each school district.
(2) Forty dollars ($40) multiplied by the average daily
membership of each school district multiplied by the percentage
of students that are economically disadvantaged. As used in this
paragraph, the term "economically disadvantaged" shall mean the
economically disadvantaged status of a student as reported by a
school district, intermediate unit or area career and technical
school through the Pennsylvania Information Management System
(PIMS) and determined based upon poverty data sources such as
eligibility for Temporary Assistance for Needy Families,
Medicaid or free or reduced-price lunch, census data, residence
in an institution for the neglected or delinquent or residence
in a foster home.
(b.2) Beginning with the school year 2023-2024 and each
school year thereafter, the Secretary of Health shall annually
adjust the amount of the reimbursement under subsection (b.1)
by the positive percent change in the Consumer Price Index for
All Urban Consumers for the Pennsylvania, New Jersey, Delaware
and Maryland area reported by the Bureau of Labor Statistics for

the twelve-month period ending in December of the school year
for which the data is being collected.
(b.3) For the school year 2020-2021, thirty-four million
dollars ($34,000,000) is hereby appropriated from the COVID-19
Response Restricted Account established under section 110-C of
the act of April 9, 1929 (P.L.343, No.176), known as "The Fiscal
Code," to reimburse each school entity as defined in section
1403.1 for the costs of providing school health services as a
one-time payment to each school entity. The reimbursement under
this subsection shall be determined as follows:
(1) Subtract each school entity's reimbursement received
under subsection (b.1) for the school year 2020-2021 from the
costs of providing support services for pupil health as reported
to the Secretary of Education on the most recent annual
financial report under section 218.
(2) Multiply the difference under paragraph (1) by each
school entity's market value/personal income aid ratio.
(3) Divide the product under paragraph (2) by the sum of all
products under paragraph (2) for all school entities.
(4) Multiply the quotient under paragraph (3) by thirty-four
million dollars ($34,000,000) for each school entity.
(b.4) The Department of Health shall post the detailed
payment calculation made to each school entity under this
section within sixty (60) days of the payment on the Department
of Health's publicly accessible Internet website.
