AN ACT
Amending Title 25 (Elections) of the Pennsylvania Consolidated
Statutes, in voter registration, further providing for
methods of voter registration, providing for same-day voter
registration and further providing for preparation and
distribution of applications.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 1321 of Title 25 of the Pennsylvania
Consolidated Statutes is amended by adding a paragraph to read:
§ 1321. Methods of voter registration.
An individual qualified to register to vote under section
1301(a) (relating to qualifications to register) may apply to
register as follows:

(5) Under section 1325.1 (relating to same-day voter
registration).
Section 2. Title 25 is amended by adding a section to read:
§ 1325.1. Same-day voter registration.

(a) General rule.--A qualified elector may register on
election day by:
(1) Appearing in person at the polling place for the
electoral district in which the individual resides.
(2) Completing and submitting a registration application
to the judge of elections.
(3) Providing a government-issued identification as
described under subsection (b) and proof of residence.
(b) Valid forms of identification.--Valid forms of
identification under subsection (a)(3) include:
(1) A valid identification card issued by the Federal
Government.
(2) A valid United States passport.
(3) A valid United States Armed Forces identification
card.
(4) A valid driver's license or identification card
issued by the Department of Transportation.
(5) A valid identification card issued by another agency
of the Commonwealth.
(c) Procedures for same-day registration.--
(1) Upon certifying the eligibility of the qualified
elector, the judge of elections at the polling place shall
issue a provisional ballot, provided by the county board of
elections, which is to be completed by the qualified elector
and sealed in an envelope along with the voter registration
application.
(2) Within 10 days of an election, the Department of
State shall approve or deny a voter registration application
under the provisions established in section 1328 (relating to
approval of registration applications).

(3) The provisional ballot may not be counted until the
Department of State has approved the voter registration
application.
(4) The qualified elector shall be notified in writing
by the Department of State as to the approval or denial of a
voter registration application.
(d) Deadline for same-day registration.--The deadline for
same-day voter registration is when the applicant is accepted in
the appropriate electoral district by the presiding judge of
elections.
Section 3. Section 1327(c) of Title 25 is amended by adding
a paragraph to read:
§ 1327. Preparation and distribution of applications.

(c) Distribution.--
* * *
(7) The secretary shall print and distribute same-day
voter registration applications to all polling places
throughout this Commonwealth. Along with the distribution of
the applications, the secretary shall include instructions to
inform the applicant of the same-day voter registration
application process and the process for counting the
applicant's vote and verifying the applicant's eligibility.

Section 4. This act shall take effect immediately.
