AN ACT
Amending Title 61 (Prisons and Parole) of the Pennsylvania
Consolidated Statutes, in general administration, further
providing for powers and duties of Department of Corrections.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 1105(a) of Title 61 of the Pennsylvania
Consolidated Statutes is amended by adding a paragraph to read:
ยง 1105. Powers and duties of department.
(a) General rule.--The department shall have the power and
its duty shall be:

(3) To establish and implement a staffing plan for State
correctional institutions that ensures that more than one
corrections officer is on duty in all areas where inmates are
present, except in unforeseen emergency circumstances.

Section 2. This act shall take effect in 60 days.
