AN ACT
Amending Titles 35 (Health and Safety) and 53 (Municipalities
Generally) of the Pennsylvania Consolidated Statutes, in
miscellaneous provisions, providing for credits in civil
service examinations; and, in employees, further providing
for applicability to civil service laws and providing for
credits in civil service examinations.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 35 of the Pennsylvania Consolidated
Statutes is amended by adding a section to read:
§ 7715. Credits in civil service examinations.
(a) Preference.--The following apply:
(1) If an eligible firefighter takes an examination for
appointment in the civil service of a municipal fire
department within this Commonwealth, the eligible
firefighter's examination shall be marked or graded 15%
perfect before the quality or contents of the examination are
considered.
(2) When the examination of an eligible firefighter

under this section is completed and graded, the grading or
percentage shall be added to the 15%, and the total mark or
grade shall represent the final grade or classification of
the eligible firefighter, which shall determine standing on
the eligible list.
(b) Limitation.--If an eligible firefighter is given
preference under 51 Pa.C.S. Ch. 71 (relating to veterans'
preference), the preference under this section shall not apply.
(c) Definitions.--As used in this section, the following
words and phrases shall have the meanings given to them in this
subsection unless the context clearly indicates otherwise:
"Eligible firefighter." A paid firefighter applying for a
position with a fire department in a municipality which serves
the high school from which the paid firefighter graduated.
Section 2. Section 2166 of Title 53 is amended to read:
§ 2166. Applicability to civil service laws.
[This] Except as provided under section 2166.2 (relating to
credits in civil service examinations), this subchapter shall
not be construed to exempt any police officer or other officer
or employee from the provisions of the existing civil service or
tenure laws.
Section 3. Title 53 is amended by adding a section to read:
§ 2166.2. Credits in civil service examinations.
(a) Preference.--The following apply:
(1) If an eligible police officer takes an examination
for appointment in the civil service of a municipal police
department within this Commonwealth, the eligible police
officer's examination shall be marked or graded 15% perfect
before the quality or contents of the examination are
considered.

(2) When the examination of an eligible police officer
under this section is completed and graded, the grading or
percentage shall be added to the 15%, and the total mark or
grade shall represent the final grade or classification of
the eligible police officer, which shall determine standing
on the eligible list.

(c) Definitions.--As used in this section, the following
words and phrases shall have the meanings given to them in this
subsection unless the context clearly indicates otherwise:
"Eligible police officer." A police officer applying for a
position with a police department in a municipality which serves
the high school from which the police officer graduated.
Section 4. This act shall take effect in 60 days.
