AN ACT
Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
Statutes, in inspection of vehicles, further providing for
requirement for periodic inspection of vehicles.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 4702(f) of Title 75 of the Pennsylvania
Consolidated Statutes is amended and the section is amended by
adding subsections to read:
ยง 4702. Requirement for periodic inspection of vehicles.

(f) [Emission] Biennial inspection.--Subject vehicles
operated in this Commonwealth must be emission inspected as
provided in section 4706 (relating to prohibition on
expenditures for emission inspection program)[.], and vehicle
emission inspection of subject vehicles, unless exempted from
the requirements for emission inspection under subsection (g),
shall be on a biennial basis. Starting January 1 for when a
biennial emission inspection is allowed following the approval

in subsection (i), vehicles manufactured in an odd-numbered year
shall receive an emission inspection during an odd-numbered
year, and vehicles manufactured in an even-numbered year shall
receive an emission inspection during an even-numbered year. The
department shall notify the official inspection stations on a
periodic basis of the staggered biennial emission inspections.

(h) Notification to Environmental Protection Agency.--The
Department of Environmental Protection shall notify the
Environmental Protection Agency of the modifications to the
vehicle emission program in subsection (f) and of the intent to
seek its approval of the plan in accordance with the
requirements of Federal law. The department shall notify the
chair and minority chair of the Transportation Committee of the
Senate, the chair and minority chair of the Transportation
Committee of the House of Representatives, the chair and
minority chair of the Environmental Resources and Energy
Committee of the Senate and the chair and minority chair of the
Environmental Resources and Energy Committee of the House of
Representatives of the department's notification to the
Environmental Protection Agency.
(i) Notice of approval.--Upon approval by the Environmental
Protection Agency under subsection (h), the secretary shall
transmit notice of the approval to the Legislative Reference
Bureau for publication in the Pennsylvania Bulletin.
Section 2. This act shall take effect in 120 days.
