AN ACT
Amending Title 53 (Municipalities Generally) of the Pennsylvania
Consolidated Statutes, in preemptions, further providing for
local regulation of unmanned aircraft prohibited.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 305(b) of Title 53 of the Pennsylvania
Consolidated Statutes, added October 12, 2018 (P.L.516, No.78),
is amended to read:
§ 305. Local regulation of unmanned aircraft prohibited.

(b) Municipal use and property.--Nothing under this section
or 18 Pa.C.S. § 3505 shall prohibit a municipality from:
(1) regulating the operation, control, retrieval or launch
of an unmanned aircraft of any size, design or specification on
or from municipal land, water or structures. Nothing in this
paragraph shall be construed to limit Federal, State or local
governmental response to fire, rescue, police or other emergency
matters or the engagement by those entities in any legitimate

governmental function; or
(2) using unmanned aircraft within the boundaries of the
municipality for municipal purposes, including excepted
activities under 18 Pa.C.S. § 3505(c) and (d) when undertaken by
municipal employees or agents, and regulating that use.

Section 2. This act shall take effect in 60 days.
