A RESOLUTION
Urging the Congress of the United States, the President of the
United States and the Environmental Protection Agency to
delay the requirements of the MS4 storm water management
program for a period of two years in response to the COVID-19
crisis.
WHEREAS, The Federal Water Pollution Control Act (62 Stat.
1155, 33 U.S.C. ยง 1251 et seq.) allows the Environmental
Protection Agency (EPA) to regulate water pollution through the
National Pollutant Discharge Elimination System by requiring
regulated municipalities and other entities to create storm
water management plans and obtain permits for discharges of
storm water from their municipal separate storm sewer systems
(MS4s); and
WHEREAS, In seeking to comply with this mandate from the EPA
as enforced by the Pennsylvania Department of Environmental
Protection, municipalities in this Commonwealth have
increasingly begun placing tremendous economic burdens on our
residents, businesses and property owners by imposing new or

increased fees on them; and
WHEREAS, Residents and businesses throughout this
Commonwealth are facing unprecedented challenges because of the
COVID-19 crisis; and
WHEREAS, Federal, State and local governments must take
action to relieve economic burdens on individuals and businesses
who are struggling during these trying times to facilitate our
country's economic recovery and ensure that our citizens can
keep as much of their money as possible for essential needs;
therefore be it
RESOLVED, That the House of Representatives of the
Commonwealth of Pennsylvania urge the Congress of the United
States, the President of the United States and the Environmental
Protection Agency to delay the requirements of the MS4 storm
water management program for a period of two years in response
to the COVID-19 crisis; and be it further
RESOLVED, That the House of Representatives of the
Commonwealth of Pennsylvania urge the Congress of the United
States to enact legislation delaying mandated compliance
deadlines for states and municipalities of the MS4 storm water
management program for a period of two years to facilitate
economic recovery from the COVID-19 crisis; and be it further
RESOLVED, That the House of Representatives of the
Commonwealth of Pennsylvania urge the President of the United
States and the Administrator of the Environmental Protection
Agency to extend compliance deadlines for states and
municipalities of the MS4 storm water management program for a
period of two years to facilitate economic recovery from the
COVID-19 crisis; and be it further
RESOLVED, That a copy of this resolution be transmitted to

the presiding officers of each house of Congress, each member of
the Pennsylvania Congressional Delegation, the Administrator of
