AN ACT
Amending Title 3 (Agriculture) of the Pennsylvania Consolidated
Statutes, providing for the regulation of hemp extract and
imposing duties on the Department of Agriculture.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 3 of the Pennsylvania Consolidated Statutes
is amended by adding a chapter to read:

§ 1701. Scope of chapter.
This chapter relates to the production, processing,
transportation, distribution and sale of hemp extract.
§ 1702. Definitions.
The following words and phrases when used in this chapter

shall have the meanings given to them in this section unless the
context clearly indicates otherwise:
"Hemp extract." Any product made or derived from industrial
hemp, and any part of such plant, including the seeds thereof
and all derivatives, extracts, cannabinoids, isomers, acids,
salts, and salts of isomers, whether growing or not, with a
delta-9-tetrahydrocannabinol concentration of not more than an
amount of the plant Cannabis sativa L.
§ 1703. Regulations.
(a) General rule.--Notwithstanding any other law to the
contrary, industrial hemp may be produced, processed,
transported, distributed and sold in a manner consistent with
the regulations promulgated under subsection (b) and all Federal
laws, regulations and orders.
(b) Regulations.--The department shall promulgate rules and
regulations governing the production, processing,
transportation, distribution and sale of hemp extract in this
Commonwealth.
Section 2. This act shall take effect in 60 days.
