AN ACT
Amending Title 74 (Transportation) of the Pennsylvania
Consolidated Statutes, in turnpike, further providing for
collection and disposition of tolls and other revenue.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 8116 of Title 74 of the Pennsylvania
Consolidated Statutes is amended by adding subsections to read:
ยง 8116. Collection and disposition of tolls and other revenue.

(a.1) Exemption.--Notwithstanding any other provision of
this part, the commission may not, on and after the effective
date of this subsection, charge or collect a surcharge or other
fee for toll collection by registration plate from an operator
or owner of a vehicle registered in this Commonwealth in excess
of the rate fixed by the commission for electronic toll
collection.
(a.2) Two-tiered toll rate.--The commission shall charge and
collect a higher rate for electronic toll collection devices not

issued by the commission. The higher rate charged under this
subsection shall not exceed the toll rate charged by the
commission for any nonelectronic toll collection.
