AN ACT
Amending the act of June 3, 1937 (P.L.1333, No.320), entitled
"An act concerning elections, including general, municipal,
special and primary elections, the nomination of candidates,
primary and election expenses and election contests; creating
and defining membership of county boards of elections;
imposing duties upon the Secretary of the Commonwealth,
courts, county boards of elections, county commissioners;
imposing penalties for violation of the act, and codifying,
revising and consolidating the laws relating thereto; and
repealing certain acts and parts of acts relating to
elections," in county boards of elections, further providing
for powers and duties of county boards.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 302 of the act of June 3, 1937 (P.L.1333,
No.320), known as the Pennsylvania Election Code, is amended by
adding a subsection to read:
Section 302. Powers and Duties of County Boards.--The county
boards of elections, within their respective counties, shall
exercise, in the manner provided by this act, all powers granted
to them by this act, and shall perform all the duties imposed
upon them by this act, which shall include the following:

(q) To conduct the following prior to the election held in
this Commonwealth on November 3, 2020, or any primary or
election held during a declaration of disaster emergency under
35 Pa.C.S. ยง 7301(c) (relating to general authority of
Governor):
(1) Select and designate, not less than twenty days prior to
an election, any public or private building situated in another
election district within a county as the polling place for an
election district, notwithstanding the location of the building
in the election district. A polling place may be selected and
designated under this subsection without the approval of a
court.
(2) Consolidate two or more polling places, except that the
consolidation of a polling place may not result in more than a
sixty percent reduction of polling place locations in the
county, except for necessitous circumstances and as approved by
the Department of State. Two or more polling places may be
located in the same building. A polling place selected and
designated under this paragraph or paragraph (1) must be
directly accessible to a voter by a public street or
thoroughfare.
(3) Post, not less than fifteen days prior to a primary or
election in this Commonwealth, in a conspicuous place at the
office of the county board of elections, a list of each place at
which the election is to be held in each election district of
the county. The list shall be available for public inspection at
the office of the county board of elections and posted on the
county's publicly accessible Internet website. Notice of
availability of the list shall be transmitted to the Legislative

Reference Bureau for publication in the Pennsylvania Bulletin.
Section 2. All regulations and parts of regulations are
abrogated to the extent of any inconsistency with the provisions
of this act.
Section 3. This act shall take effect immediately.
