AN ACT
Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
act relating to the public school system, including certain
provisions applicable as well to private and parochial
schools; amending, revising, consolidating and changing the
laws relating thereto," in community colleges, further
providing for tuition; and, in the State System of Higher
Education, further providing for powers and duties of the
Board of Governors.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 1908-A of the act of March 10, 1949
(P.L.30, No.14), known as the Public School Code of 1949, is
amended by adding a subsection to read:
Section 1908-A. Tuition.--* * *
(f) A student who meets all of the following requirements
shall be considered a resident of this Commonwealth for the
purpose of determining tuition rates:
(1) attended a high school in this Commonwealth for a
minimum of three years;
(2) graduated from a high school, or received the equivalent
of a high school diploma, in this Commonwealth;

(3) is registered as an entering student or is enrolled in a
community college and originally enrolled not earlier than the
fall semester of the 2013-2014 academic year;
(4) in the case of a student who is not a United States
citizen, is a dependent of a parent or guardian who holds an H-
1B visa; and
(5) resides in this Commonwealth at the time of application
to and attendance of the community college.
Section 2. Section 2006-A(a)(11) of the act is amended to
read:
Section 2006-A. Powers and Duties of the Board of
Governors.--(a) The Board of Governors shall have overall
responsibility for planning and coordinating the development and
operation of the system. The powers and duties of the Board of
Governors shall be:

(11) To fix the levels of tuition fees, except student
activity fees. Tuition fees shall include a differential for
such charges between students who are residents of the
Commonwealth and students who are nonresidents. A student who
meets all of the following requirements shall be considered a
resident of this Commonwealth for the purpose of determining
tuition rates:
(i) attended a high school in this Commonwealth for a
minimum of three years;
(ii) graduated from a high school, or received the
equivalent of a high school diploma, in this Commonwealth;
(iii) is registered as an entering student or is enrolled in
an institution and originally enrolled not earlier than the fall
semester of the 2013-2014 academic year;

(iv) in the case of a student who is not a United States
citizen, is a dependent of a parent or guardian who holds an H-
1B visa; and
(v) resides in this Commonwealth at the time of application
to and attendance of the institution.

Section 3. This act shall take effect immediately.
