AN ACT
Amending Title 35 (Health and Safety) of the Pennsylvania
Consolidated Statutes, in COVID-19 disaster emergency,
providing for certain public events not subject to shutdowns
by government.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 35 of the Pennsylvania Consolidated
Statutes is amended by adding a section to read:
ยง 5702. Certain public events not subject to shutdowns by
government.
(a) General rule.--Notwithstanding the provisions of section
7301 (relating to general authority of Governor) or any other
law to the contrary, during the COVID-19 disaster emergency,
neither the Commonwealth nor any municipality may restrict or
impose a limitation through an executive order, proclamation,
regulation, resolution or ordinance or other official action,
including through means of a color code system or otherwise, on
the number of individuals who may lawfully gather or assemble
during any of the following events conducted on public or

private property:
(1) Fairs.
(2) Amusement rides and attractions, including
recreational activities in pools or bodies of water.
(3) Fire department carnivals.
(4) Religious worship, including weddings, funerals,
other religious rituals and religious socials.
(5) Family reunions and birthday parties.
(6) Festivals on public streets.
(7) Fishing and hunting tournaments.
(8) Animal exhibitions, including dog shows, State 4-H
Club shows and Future Farmers of America shows.
(9) Flea markets, farmers markets and garage sales.
(10) Other similar events.
(b) Nonapplicability.--Subsection (a) shall not apply to
occupancy permits issued prior to March 6, 2020, insofar as the
occupancy permits place a maximum limitation of the number of
individuals permitted to occupy a premises, such as a
restaurant, bar or other retail establishment where food,
beverages or goods or services are offered for sale to the
public.
Section 2. This act shall take effect in 60 days.
