AN ACT
Establishing a Statewide registry of caregivers who abuse
individuals with disabilities or special needs; and imposing
duties on the Department of Human Services.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Short title.
This act shall be known and may be cited as the Abusive
Caregiver Registry Act.
Section 2. Definitions.
The following words and phrases when used in this act shall
have the meanings given to them in this section unless the
context clearly indicates otherwise:
"Caregiver." An individual who has a legal or contractual
duty to provide services for the care, custody or supervision of
an individual with a disability or special needs.
"Department." The Department of Human Services of the
Commonwealth.

"Registry." The Statewide Registry of Abusive Caregivers
established by this act.
Section 3. Statewide Registry of Abusive Caregivers.
(a) Establishment.--The department shall establish and
maintain a Statewide registry of caregivers who have been
charged and caregivers who have been convicted with an offense
that involves the abuse or neglect of an individual with a
disability or special needs. The registry shall:
(1) Be a complete and systematic index of all records
that relate to such charges and convictions.
(2) Be composed of an electronic database and digitized
records.
(3) Be able to communicate with abusive caregiver
registries established in other jurisdictions.
(4) Consist of such information from records as
determined by the department.
(b) Cooperation.--There shall be cooperation between the
Pennsylvania State Police, State and county correctional
institutions, the Pennsylvania Board of Probation and Parole,
the county office of probation and parole, any court with
jurisdiction over a caregiver that has been charged or convicted
with an offense that involves the abuse or neglect of an
individual with a disability or special needs, the chief
juvenile probation officer of the court, juvenile probation and
parole and Commonwealth agencies to ensure that the information
set forth in subsection (a) is provided and placed in the
registry.
(c) Confidentiality.--The registry may not disclose the name
or identifying information of an individual with a disability or
special needs.

(d) Access.--Except for information prohibited from
disclosure under subsection (c), the department shall post
information from the registry on the department's publicly
accessible Internet website.
(e) Correction of information.--The department shall
establish a procedure for correcting false or otherwise
incorrect information contained on the registry.
(f) Regulations.--The department shall promulgate
regulations necessary for administration of this act.
Section 4. Effective date.
This act shall take effect in 60 days.
