AN ACT
Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
Statutes, in licensing of drivers, further providing for
examination of applicant for driver's license.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 1508 of Title 75 of the Pennsylvania
Consolidated Statutes is amended by adding a subsection to read:
§ 1508. Examination of applicant for driver's license.

(h) Waiver of examination of applicant for driver's
license.--Notwithstanding any other law, as a result of a
declaration by the Governor of disaster emergency under 35
Pa.C.S. § 7301(c) (relating to general authority of Governor)
that is pertinent to a public health emergency or crisis, the
following shall apply:
(1) The department shall develop a process through which
an applicant for a driver's license may, for the duration of
the state of disaster emergency, apply for an exemption from

the examination of the applicant for the driver's license.
The process shall include the following:
(i) The development of a form regarding the
exemption, which the department shall make readily
available through the mail or electronic means.
(ii) The submittal by the applicant, through the
mail or electronic means, of the form regarding the
exemption and any other forms required by the department
or by law for the licensing of drivers.
(2) Upon submission to and acceptance by the department
of the form for exemption and any other forms required by the
department or by law for the licensing of drivers, the
applicant shall be issued a temporary junior or regular
driver's license via the mail.
(3) The department shall develop a process through which
a temporary junior or regular driver's license issued under
this subsection may be made a permanent license upon the
termination or expiration under 35 Pa.C.S. § 7301(c) of the
declaration of disaster emergency. The process shall include,
but not be limited to, the completion of the examination of
the applicant for a driver's license within six months from
the date of the termination or expiration of the declaration
of disaster emergency.
(4) An applicant for a driver's license shall be
eligible for exemption from the examination of the applicant
for a driver's license if:
(i) The form regarding the exemption and any other
forms required by the department or by law for the
licensing of drivers are submitted to and accepted by the
department during the state of disaster emergency.

(ii) For an applicant who is under 18 years of age,
the applicant has satisfied the requirements listed under
section 1505 (relating to learners' permits).
(iii) For an applicant who is 18 years of age or
older, the applicant:
(A) has held a learner's permit for a period of
six months; and
(B) submits to the department a certification
form signed by an individual who is 18 years of age
or older stating that the applicant has completed 65
hours of practical driving experience:
(I) except in the case of a Class M license
to operate a motorcycle; and
(II) that must include no fewer than 10
hours of nighttime driving and five hours of
inclement weather driving.
(5) The department shall develop the certification form
under paragraph (4)(iii)(B) and shall make the certification
form readily available through the mail or electronic means.
Section 2. This act shall take effect in 60 days.
