AN ACT
Amending Title 35 (Health and Safety) of the Pennsylvania
Consolidated Statutes, in the Governor and disaster
emergencies, further providing for general authority of
Governor.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 7301 of Title 35 of the Pennsylvania
Consolidated Statutes is amended by adding a subsection to read:
§ 7301. General authority of Governor.

(g) Posting requirements.--The following shall apply:
(1) If the Governor declares a disaster emergency under
this part that includes an executive order affecting the
operations of private businesses, regardless of whether the
businesses are licensed by the Commonwealth, the Governor
must post all records directly related to the granting of a
waiver or the issuance of a denial, an exclusion or other

exception on a publicly accessible Internet website.
(2) A record under this subsection must be posted within
24 hours of the granting of the wavier or the issuance of the
denial, exclusion or other exception.
Section 2. The addition of 35 Pa.C.S. § 7301(g) shall apply
retroactively to March 16, 2020.
Section 3. This act shall take effect immediately.
