AN ACT
Amending Title 35 (Health and Safety) of the Pennsylvania
Consolidated Statutes, in Commonwealth services, providing
for small retail business operation during COVID-19 disaster
emergency.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 35 of the Pennsylvania Consolidated
Statutes is amended by adding a section to read:
ยง 7309. Small retail business operation during COVID-19
disaster emergency.
(a) General rule.--Notwithstanding the provisions of this
chapter or any other provision of law to the contrary, a small
retail business may operate during the COVID-19 disaster
emergency if the small retail business has:
(1) A brick and mortar location.
(2) Ten or fewer employees worldwide.
(b) Conditions.--A small retail business operating under
subsection (a) shall adhere to the following conditions:

(1) Shopping may only be done through online ordering or
by phone.
(2) A customer shall receive their purchase by curbside
delivery, direct delivery to the customer's home, mail or
other service.
(3) Customers shall not be permitted inside the brick
and mortar location of the small retail business.
(4) The small retail business must follow all health and
safety guidelines issued by the Centers for Disease Control
and Prevention or by the Commonwealth to protect the
employees and customers of the retail business.
(c) Definitions.--As used in this section, the following
words and phrases shall have the meanings given to them in this
subsection unless the context clearly indicates otherwise:
"COVID-19 disaster emergency." The proclamation of disaster
emergency issued by the Governor on March 6, 2020, published at
50 Pa.B. 1644 (March 21, 2020), and any renewal of the state of
disaster emergency.
Section 2. This act shall take effect in 10 days.
