AN ACT
Amending the act of April 12, 1951 (P.L.90, No.21), entitled "An
act relating to alcoholic liquors, alcohol and malt and
brewed beverages; amending, revising, consolidating and
changing the laws relating thereto; regulating and
restricting the manufacture, purchase, sale, possession,
consumption, importation, transportation, furnishing, holding
in bond, holding in storage, traffic in and use of alcoholic
liquors, alcohol and malt and brewed beverages and the
persons engaged or employed therein; defining the powers and
duties of the Pennsylvania Liquor Control Board; providing
for the establishment and operation of State liquor stores,
for the payment of certain license fees to the respective
municipalities and townships, for the abatement of certain
nuisances and, in certain cases, for search and seizure
without warrant; prescribing penalties and forfeitures;
providing for local option, and repealing existing laws," in
Pennsylvania Liquor Stores, providing for the establishment
of a disaster emergency curbside program.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of April 12, 1951 (P.L.90, No.21), known
as the Liquor Code, is amended by adding a section to read:
Section 307. Disaster Emergency Curbside Program.--(a) The
board shall develop a curbside sales program for Pennsylvania

Liquor Stores to allow an individual, including a liquor
licensee, to purchase liquor. The board shall implement the
curbside sales program no later then seven days after the
effective date of this section.
(b) The curbside sales program developed under subsection
(a) shall be in effect during the duration of a disaster
emergency.
(c) Nothing in this section shall prohibit the board from
further store openings in the future during the disaster
emergency, including store openings that allow customer access
in the board's retail stores.
(d) As used in this section, the following words and phrases
shall have the meanings given to them in this subsection unless
the context clearly indicates otherwise:
"Disaster emergency." A declaration by the Governor of a
disaster emergency under 35 Pa.C.S. § 7301(c) (relating to
general authority of Governor).
"Duration." The period beginning on the date of a disaster
emergency and ending on the date the declaration is terminated
or expires under 35 Pa.C.S. § 7301(c).
Section 2. This act shall take effect immediately.
