AN ACT
Amending Title 18 (Crimes and Offenses) of the Pennsylvania
Consolidated Statutes, in firearms and other dangerous
articles, providing for the offense of carrying firearms
while under the influence of alcohol.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 18 of the Pennsylvania Consolidated
Statutes is amended by adding a section to read:
ยง 6108.1. Carrying firearms while under the influence of
alcohol.
(a) Offense defined.--It shall be unlawful for a person who
holds a license issued under this chapter to carry a firearm on
or about the person to carry a firearm after imbibing a
sufficient amount of alcohol such that the alcohol concentration
in the person's blood or breath is at least 0.08%.
(b) Grading.--
(1) A person who violates subsection (a) commits a
summary offense and shall, upon conviction, be sentenced to
