AN ACT
Amending Title 66 (Public Utilities) of the Pennsylvania
Consolidated Statutes, in service and facilities, providing
for overhead utility pole repair by public utility.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 66 of the Pennsylvania Consolidated
Statutes is amended by adding a section to read:
ยง 1512. Overhead utility pole repair by public utility.
(a) Maintenance of overhead utility pole.--A public utility
whose distribution infrastructure includes the responsibility of
maintenance of overhead utility poles, on notification by the
municipality of a damaged or hazardous pole located within its
jurisdiction, shall, within 30 days from the notification under
this subsection:
(1) replace the damaged overhead utility pole with a new
pole; or
(2) repair the damaged overhead utility pole to a new
and safe condition where the pole must be a single pole

secured in the ground. If the overhead utility pole cannot be
sufficiently repaired, the pole shall be removed in its
entirety and all overhead lines must be removed and placed on
a new overhead utility pole.
(b) Explanation of delay.--The public utility shall explain
any delay in the repair or replacement of the damaged overhead
utility pole to the municipality if the public utility fails to
meet the requirements of subsection (a).
(c) Complaint.--If after 90 days from the notification to
the public utility under subsection (a) the public utility has
failed to meet the requirements of subsection (a), the
municipality may file a complaint with the commission for any
insufficient, defective, noncompliant or incomplete repair of an
overhead utility pole. The commission shall immediately set a
time for a hearing and provide notice under section 703
(relating to fixing of hearings) to the public utility of the
complaint for failure to comply with this section.
Section 2. This act shall take effect in 60 days.
