AN ACT
Amending Title 23 (Domestic Relations) of the Pennsylvania
Consolidated Statutes, in child protective services, further
providing for release of information in confidential reports
and for exchange of information.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 6340(a)(13) of Title 23 of the
Pennsylvania Consolidated Statutes is amended to read:
§ 6340. Release of information in confidential reports.
(a) General rule.--Reports specified in section 6339
(relating to confidentiality of reports) shall only be made
available to:

(13) School administrators and child-care service
employers, as provided under this paragraph. The following
shall apply:
(i) If the alleged perpetrator is a school employee
or child-care service employee, school administrators and

child-care service employers shall receive notice of a
pending allegation and the final status of the report
following the investigation as to whether the report is
indicated, founded or unfounded.
(ii) Information disclosed pursuant to this
paragraph shall be provided to the school administrator
or child-care service employer within ten days of the
completion of the investigation.
(iii) If the perpetrator is a school employee, the
notice of the final status of the report shall be sent to
the Department of Education within ten days of the
completion of the investigation.
(iv) If the alleged perpetrator is not a school
employee, a school administrator shall receive
information regarding a founded or indicated report made
pursuant to this chapter for the sole purpose of
effectuating section 6340.1(e) (relating to exchange of
information).

Section 2. Section 6340.1 of Title 23 is amended by adding a
subsection to read:
§ 6340.1. Exchange of information.

(e) School administrators.--The department shall consult
with the Department of Education to develop and promulgate
regulations to do the following:
(1) Require school administrators to notify the
department of a student's unexcused absence:
(i) after one excused absence if the student is
currently the subject of a founded or indicated report of

child abuse; or
(ii) after three unexcused absences if the student
was previously the subject of a founded or indicated
report.
(2) Provide for sharing of information regarding child
abuse reports between the department and school
administrators to effectuate paragraph (1).
(3) Specify when a student is considered to be a current
subject of a founded or indicated report and when a student
is considered to be a previous subject of a founded or
indicated report.
(4) Maintain confidentiality during the sharing of
information between school administrators and the department
under this subsection.
Section 3. This act shall take effect in 60 days.
