AN ACT
Authorizing the Department of General Services, with the
approval of the Governor, to grant and convey to the borough
of Plymouth a permanent storm water drainage easement in
Plymouth Borough, Luzerne County.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Conveyance in Plymouth Borough, Luzerne County.
(a) Authorization.--The Department of General Services, with
the approval of the Department of Military and Veterans Affairs
and the Governor, is hereby authorized on behalf of the
Commonwealth of Pennsylvania to grant and convey to the Borough
of Plymouth a permanent storm water drainage easement from lands
of the Commonwealth of Pennsylvania at the Plymouth Readiness
Center situate in Plymouth Borough, County of Luzerne for the
purpose of establishing and maintaining a storm water drainage
channel to properly collect, convey and discharge upstream
runoff into Coalbrook Creek to reduce flooding hazards to
downstream property owners for $1.00 and under terms and
conditions to be established in an easement agreement.

(b) Property description.--The permanent storm water
drainage easement to be conveyed under section 1 totals
approximately 0.525 acres of land, bounded and more particularly
described as follows:
ALL that certain piece or parcel of land situate in Plymouth
Borough, County of Luzerne and Commonwealth of Pennsylvania,
bounded and described as follows, to wit:
BEGINNING at the westerly corner of lands of now or formerly
Commonwealth of Pennsylvania, on the northeasterly side of an
unimproved alley, and also being a common corner of lands of now
or formerly Elaine Haines;
THENCE along said lands of Haines, and lands of now or
formerly Alfred R. & Marion L. Ottensman, North 54 degrees 39
minutes 27 seconds East, 222.07 feet to a point, thence through
the lands of the said Commonwealth of Pennsylvania, the
following eight courses;
1. South 84 degrees 58 minutes 30 seconds East, 69.30
feet to a point;
2. South 87 degrees 15 minutes 17 seconds East, 167.65
feet to a point;
3. North 74 degrees 08 minutes 44 seconds East, 205.17
feet to a point;
4. South 36 degrees 57 minutes 27 seconds East, 37.52
feet to a point;
5. South 74 degrees 08 minutes 44 seconds West, 224.40
feet to a point;
6. North 87 degrees 15 minutes 17 seconds West, 160.71
feet to a point;
7. South 84 degrees 42 minutes 23 seconds West, 100.34
feet to a point;

feet to a point along the said northeasterly side of an
alley;
THENCE along said northeasterly side of an alley, North 36
degrees 49 minutes 33 seconds West, 30.01 feet to the point of
BEGINNING.
CONTAINING 22,877 square feet (0.525-acres) of land more or
less.
BEING a portion of the parcel conveyed to the Commonwealth of
Pennsylvania, by deed dated March 14, 1961 recorded in Deed Book
1473 at page 308, in the Luzerne County Office of the Recorder
of Deeds.
THE above described easement is more particularly shown on a
Permanent Drainage Easement Plat, Lands of Commonwealth of
Pennsylvania, as prepared by the office of PennEastern
Engineers, LLC, dated November 5, 2018, and on file with the
Department of General Services.
(c) Agreement.--The easement agreement and any other
documents necessary to effectuate the conveyance under
subsection (b) shall be executed by the Secretary of General
Services in the name of the Commonwealth of Pennsylvania.
(d) Costs and fees.--Costs and fees incidental to the
conveyance described under subsection (b) shall be borne by the
Grantee.
(e) Expiration.--In the event that the parties have not
entered into an easement agreement within two years of the
effective date of this act, the authorization under subsection
(a) shall expire.
Section 2. Effective date.
This act shall take effect in 60 days.
