AN ACT
Amending Title 18 (Crimes and Offenses) of the Pennsylvania
Consolidated Statutes, in criminal history record
information, further providing for expungement.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 9122(b) of Title 18 of the Pennsylvania
Consolidated Statutes is amended by adding a paragraph to read:
ยง 9122. Expungement.

(b) Generally.--Criminal history record information may be
expunged when:

(4) An individual who is the subject of the information
petitions the court for the expungement of a conviction under
section 13(a)(31) of the act of April 14, 1972 (P.L.233,
No.64), known as The Controlled Substance, Drug, Device and
Cosmetic Act, and shows all of the following:

(i) The facts from which the conviction arose
preceded the effective date of the act of April 17, 2016
(P.L.84, No.16), known as the Medical Marijuana Act.
(ii) The conviction arose from the individual's
possession of marijuana intended for the medical use of
the individual or a minor under the individual's care.
(iii) The individual has been free from conviction
of any drug-related offense since enactment of the
Medical Marijuana Act.
(iv) The individual is a patient in possession of a
lawfully issued identification card under the Medical
Marijuana Act.
(v) The individual has completed all court-ordered
financial obligations of the sentence.

Section 2. This act shall take effect in 60 days.
