AN ACT
Amending Title 3 (Agriculture) of the Pennsylvania Consolidated
Statutes, in food protection, providing for certain sales of
beverages by children.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 3 of the Pennsylvania Consolidated Statutes
is amended by adding a section to read:
ยง 5713.1. Certain sales of beverages by children.
Notwithstanding any other provision of this subchapter or any
other law, no licensor, county, city, borough, incorporated
town, township, local public health authority or homeowners
association may adopt or enforce a regulation, ordinance, order
or rule that prohibits or regulates, including by requiring a
license, permit or fee, the occasional sale of lemonade or other
nonalcoholic beverages from a stand on private property by an
individual under 18 years of age.

Section 2. This act shall take effect immediately.
