AN ACT
Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
act to consolidate, editorially revise, and codify the public
welfare laws of the Commonwealth," in departmental powers and
duties as to licensing, further providing for definitions and
providing for inspection for continuing conformity to
license.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The definition of "mental health establishment"
in section 1001 of the act of June 13, 1967 (P.L.31, No.21),
known as the Human Services Code, is amended to read:
Section 1001. Definitions.--As used in this article--

"Mental health establishment" means any premises or part
thereof, private or public, for the care of individuals who
require care because of mental illness, [mental retardation]
intellectual disability or inebriety but shall not be deemed to
include the private home of a person who is rendering such care
to a relative.

Section 2. The act is amended by adding a section to read:
Section 1017. Inspection for Continuing Conformity to
License.--(a) An authorized agent of the department shall enter
and inspect, as provided under section 1016, a facility licensed
under this act for the purpose of determining continuing
conformity of the licensee to this act and to the applicable
regulations of the department. Each facility shall be inspected
annually under this subsection.
(b) If it is determined under subsection (a) that a facility
is operating outside the scope of its license, the department
shall revoke the facility's license to operate. The facility
shall then be required to apply for the appropriate licensure
under this act.
Section 3. This act shall take effect in 60 days.
