AN ACT
Amending the act of June 3, 1937 (P.L.1333, No.320), entitled
"An act concerning elections, including general, municipal,
special and primary elections, the nomination of candidates,
primary and election expenses and election contests; creating
and defining membership of county boards of elections;
imposing duties upon the Secretary of the Commonwealth,
courts, county boards of elections, county commissioners;
imposing penalties for violation of the act, and codifying,
revising and consolidating the laws relating thereto; and
repealing certain acts and parts of acts relating to
elections," in primary and election expenses, providing for
out-of-state political committees and reporting.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of June 3, 1937, (P.L.1333, No.320),
known as the Pennsylvania Election Code, is amended by adding a
section to read:
Section 1626.2. Out-of-State Political Committees;
Reporting.--
(a) (1) Notwithstanding any other provision of law or
regulation, an out-of-state political committee organized for

the purpose of supporting or opposing a candidate, a question
appearing on the ballot or a ballot initiative in another state
that is not otherwise required to report under this act or any
other provision of law or regulation of this Commonwealth shall
report as required in this section if the out-of-state political
committee makes an expenditure supporting or opposing a
political committee in this Commonwealth, a Statewide candidate,
a candidate for the Pennsylvania Senate or a candidate for the
Pennsylvania House of Representatives.
(2) The out-of-state political committee shall file with the
Secretary of the Commonwealth, on a form designed by the
Secretary of the Commonwealth, a statement disclosing:
(i) The name, address and telephone number or electronic
mail address of the out-of-state political committee.
(ii) The purpose of the out-of-state political committee.
(iii) The names, addresses and titles of the committee's
officers or, if the committee has no officers, the names,
addresses and the titles of responsible leaders.
(iv) The name, office sought and party affiliation of each
candidate in this Commonwealth whom the out-of-state political
committee is supporting or opposing and, if the out-of-state
committee is supporting or opposing the entire ticket of any
political party, the name of the party.
(v) A ballot question supported or opposed in this
Commonwealth, if any, and whether the out-of-state political
committee is in favor of or opposed to the ballot question.
(vi) The name and address of each person residing in this
Commonwealth that has a place of business in this Commonwealth
who has made one or more contributions in the aggregate of more
than twenty-five dollars ($25) to the out-of-state political

committee during the current calendar year, together with the
money value and date of the contributions.
(vii) The name, address and employer of each person residing
outside this Commonwealth who has made one or more contributions
in the aggregate of more than two thousand five hundred fifty
dollars ($2,550) to the out-of-state political committee during
the current calendar year, together with the money value and
date of the contributions. Annually, the Secretary of the
Commonwealth shall modify the two thousand five hundred fifty
dollar ($2,550) limit in this subsection based on percentage
change in the implicit price deflator for personal consumption
expenditures for the United States as published for the most
recent twelve-month period by the Bureau of Economic Analysis of
the United States Department of Commerce.
(viii) The name and address of each person in this
Commonwealth to whom an expenditure was made by the out-of-state
political committee with respect to a candidate or political
committee in the aggregate amount of more than fifty dollars
($50), the amount, date and purpose of the expenditure and the
total sum of the expenditure.
(ix) Any other information as the Secretary of the
Commonwealth may prescribe by rule or regulation.
(b) Each statement shall be filed no later than the tenth
day of the month following any month in which a contribution or
other expenditure reportable under subsection (a) is made. An
out-of-state political committee incurring an obligation to file
additional statements in a calendar year may satisfy the
obligation by timely filing reports that supplement previously
filed information.
Section 2. This act shall take effect in 60 days.
