AN ACT
Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
act to consolidate, editorially revise, and codify the public
welfare laws of the Commonwealth," in public assistance,
further providing for nonemergency medical transportation
services.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 443.12 of the act of June 13, 1967
(P.L.31, No.21), known as the Human Services Code, is amended by
adding subsections to read:
Section 443.12. Nonemergency Medical Transportation
Services.--* * *
(d) The department shall suspend any action to amend the
Commonwealth's State Plan under subsection (a) and may not enter
into a contract with any broker under subsection (b) for a
period of ninety days from the date the study required by

subsection (e) is delivered to the secretary.
(e) The Joint State Government Commission shall conduct a
study on the positive and negative impacts to each county of
utilizing a Statewide or regional full-risk brokerage model
under this section. The study shall approximate the potential
costs or savings such action could have for the various counties
and the Commonwealth. It shall include recommendations relating
to minimizing disruption or reduction of nonemergency
transportation services, maximizing the coordination of
nonemergency transportation services provided by different
programs and diverse funding sources and whether to provide
counties with the right to opt-out of the full-risk brokerage
model. The study shall be completed not later than one year
after the effective date of this subsection and shall be
delivered to the secretary, the chairperson of the Health and
Human Services Committee of the Senate and the chairperson of
the Human Services Committee of the House of Representatives.
Section 2. This act shall take effect immediately.
