AN ACT
Amending Title 23 (Domestic Relations) of the Pennsylvania
Consolidated Statutes, in child protective services, further
providing for investigation of reports.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 6368(d) of Title 23 of the Pennsylvania
Consolidated Statutes is amended by adding a paragraph to read:
ยง 6368. Investigation of reports.

(d) Investigative actions.--During the investigation, all of
the following shall apply:

(5) The county agency shall have access to and shall
review each record relating to the child, including medical
records, records of drug and alcohol treatment , RECORDS OF
MENTAL HEALTH TREATMENT and school records pursuant to the
cooperation required under sections 6340.1 (relating to
exchange of information) and 6346 (relating to cooperation of

other agencies). THE CONSENT OF A PARENT OR GUARDIAN OF A
CHILD OR ANY OTHER RELEASE MAY NOT BE REQUIRED TO OBTAIN THE
RECORDS REQUESTED BY THE COUNTY AGENCY UNDER THIS PARAGRAPH.

Section 2. This act shall take effect in 60 days.
