AN ACT
Amending Title 42 (Judiciary and Judicial Procedure) of the
Pennsylvania Consolidated Statutes, in forfeiture of assets,
further providing for asset forfeiture.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 5803 of Title 42 of the Pennsylvania
Consolidated Statutes is amended by adding a subsection to read:
ยง 5803. Asset forfeiture.

(m) Municipal police agency share of proceeds.--If a
municipal police agency is substantially involved in the seizure
of property ultimately forfeited by the court under section
5802, the proceeds from the forfeiture shall be distributed so
as to allocate at least 25% to the municipal police agency. The
percentage may be increased by agreement. If more than one
municipal police agency is involved, the court shall equitably
determine the portion of the 25% that shall be allocated to each
municipal police agency.

Section 2. This act shall take effect in 60 days.
