AN ACT
Amending the act of May 17, 1921 (P.L.682, No.284), entitled "An
act relating to insurance; amending, revising, and
consolidating the law providing for the incorporation of
insurance companies, and the regulation, supervision, and
protection of home and foreign insurance companies, Lloyds
associations, reciprocal and inter-insurance exchanges, and
fire insurance rating bureaus, and the regulation and
supervision of insurance carried by such companies,
associations, and exchanges, including insurance carried by
the State Workmen's Insurance Fund; providing penalties; and
repealing existing laws," in casualty insurance, providing
for health insurance coverage for immunizations administered
at a pharmacy by a pharmacist.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of May 17, 1921 (P.L.682, No.284), known
as The Insurance Company Law of 1921, is amended by adding a
section to read:
Section 635.8. Coverage for Immunizations Administered at a
Pharmacy by a Pharmacist.--(a) All health insurance policies
shall provide coverage for immunizations administered at a
pharmacy by a pharmacist.
(b) As used in this section:

(1) "Health insurance policy" means a group or individual
health or sickness or accident insurance policy, subscriber
contract or certificate issued by an entity. The term does not
include accident only, fixed indemnity, limited benefit, credit,
dental, vision, specified disease, Medicare supplement, Civilian
Health and Medical Program of the Uniformed Services (CHAMPUS)
supplement, long-term care or disability income, workers'
compensation or automobile medical payment insurance.
(2) "Pharmacist" means an individual duly licensed by the
State Board of Pharmacy to engage in the practice of pharmacy.
(3) "Pharmacy" means a property issued a permit by the State
Board of Pharmacy where drugs, devices and diagnostic agents for
human or animal consumption are stored, dispensed or compounded,
excluding offices or facilities of veterinarians licensed by the
State Board of Veterinary Medical Examiners. The term does not
include the operations of a manufacturer or distributor, as
defined in the act of April 14, 1972 (P.L.233, No.64), known as
"The Controlled Substance, Drug, Device and Cosmetic Act." In an
institution, "pharmacy" means the organized pharmacy services in
the institution under the direct supervision of a licensed
pharmacist.
Section 2. This act shall take effect immediately.
