AN ACT
Amending Title 18 (Crimes and Offenses) of the Pennsylvania
Consolidated Statutes, in theft and related offenses, further
providing for the offense of theft by failure to make
required disposition of funds received.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 3927 of Title 18 of the Pennsylvania
Consolidated Statutes is amended by adding a subsection to read:
ยง 3927. Theft by failure to make required disposition of funds
received.

(a.1) Payments received for health care services of
another.--A person commits an offense under this section if the
person obtains possession of a payment from an insurance company
for the health care services provided to another and
intentionally:
(1) fails to make payment or disposition of the amount
owed to the health care provider of the other person; and

(2) deals with the payment as his own.

Section 2. This act shall take effect in 60 days.
