AN ACT
Amending the act of August 23, 1961 (P.L.1068, No.484), entitled
"An act to provide for the creation and administration of a
Coal and Clay Mine Subsidence Insurance Fund within the
Department of Environmental Protection for the insurance of
compensation for damages to subscribers thereto; declaring
false oaths by the subscribers to be misdemeanors; providing
penalties for the violation thereof; and making an
appropriation," further providing for application for
insurance, terms of insurance, penalty for false statement
and list of mining areas.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 12 of the act of August 23, 1961
(P.L.1068, No.484), entitled "An act to provide for the creation
and administration of a Coal and Clay Mine Subsidence Insurance
Fund within the Department of Environmental Protection for the
insurance of compensation for damages to subscribers thereto;
declaring false oaths by the subscribers to be misdemeanors;
providing penalties for the violation thereof; and making an
appropriation," is amended by adding a subsection to read:

Penalty for False Statement; List of Mining Areas.--* * *
(a.1) A broker acting on behalf of a seller, financial
institution issuing the mortgage for the property and the seller
of a structure located within an anthracite or bituminous coal
or clay mine region shall conspicuously make the purchaser aware
of the existence of the subsidence insurance offered under this
act. As used in this subsection, the term "broker" shall have
the same meaning as in section 201 of the act of February 19,
1980 (P.L.15, No.9), known as the "Real Estate Licensing and
Registration Act."

Section 2. This act shall take effect in 60 days.
