AN ACT
Providing for time and place prohibition of picketing at
funerals.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Short title.
This act shall be known and may be cited as the Anti-
Picketing at Funerals Act.
Section 2. Definitions.
The following words and phrases when used in this act shall
have the meanings given to them in this section unless the
context clearly indicates otherwise:
"Funeral." A ceremony or memorial service held in connection
with the burial or cremation of a decedent, but shall not
include funeral processions on public streets or highways.
"Picketing." Protest activities engaged in by a person
located within 500 feet of a cemetery, mortuary, church or other
place of worship used as part of a funeral.
Section 3. Picketing prohibited.

No person may picket a funeral during the time period
beginning one hour prior to the start of a funeral and up to and
including one hour following the end of the funeral.
Section 4. Misdemeanor.
The following shall apply:
(1) A first violation of section 3 shall constitute a
misdemeanor of the third degree.
(2) A second or subsequent violation of section 3 shall
constitute a misdemeanor of the first degree.
Section 5. Effective date.
This act shall take effect in 60 days.
