AN ACT
Amending Title 42 (Judiciary and Judicial Procedure) of the
Pennsylvania Consolidated Statutes, in sentencing, further
providing for modification or revocation of order of
probation and for court-imposed sanctions for offenders
violating probation.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Sections 9771(b) and 9771.1(i)(2) of Title 42 of
the Pennsylvania Consolidated Statutes are amended to read:
§ 9771. Modification or revocation of order of probation.

(b) Revocation.--The court may revoke an order of probation
upon proof of the violation of specified conditions of the
probation. Upon revocation the sentencing alternatives available
to the court shall be the same as were available at the time of
initial sentencing, due consideration being given to the time
spent serving the order of probation. A term of imprisonment
upon revocation of an order of probation under this section
shall not exceed six months.

(i) Revocation of probation.--

(2) Upon revocation, the sentencing alternatives shall
be the same as were available at the time of initial
sentencing, due consideration being given to the time spent
serving the order of probation. A term of imprisonment upon
revocation of an order of probation under this subsection
shall not exceed six months.

Section 2. This act shall take effect in 60 days.
