AN ACT
Amending Title 18 (Crimes and Offenses) of the Pennsylvania
Consolidated Statutes, in assault, providing for the offense
of threat against law enforcement officer or sheriff.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 18 of the Pennsylvania Consolidated
Statutes is amended by adding a section to read:
ยง 2702.2. Threat against law enforcement officer or sheriff.
(a) Offense defined.--A person who threatens the following
ANOTHER with death or serious bodily injury commits an offense
under this section IF THE PERSON KNOWS OR HAS REASON TO KNOW
THAT THE PERSON IS ANY OF THE FOLLOWING :
(1) A law enforcement officer.
(2) A sheriff or deputy sheriff.
(3) A family or household member of an individual under
paragraph (1) or (2).
(b) Grading.--
(1) A first offense under this section constitutes a

felony of the third degree.
(2) A second or subsequent offense under this section
constitutes a felony of the second degree.
(c) Definitions.--As used in this section, the following
words and phrases shall have the meanings given to them in this
subsection unless the context clearly indicates otherwise:
"Family or household member." Spouses or persons who have
been spouses, persons living as spouses or who lived as spouses,
parents and children, other persons related by consanguinity or
affinity, current or former sexual or intimate partners or
persons who share biological parenthood.
"Law enforcement officer." As the term "peace officer" is
defined under section 501 (relating to definitions).
"Serious bodily injury." Impairment of physical condition or
substantial pain that creates a substantial risk of death or
that causes serious permanent disfigurement or protracted loss
or impairment of function of any bodily member or organ.
Section 2. This act shall take effect in 60 days.
