AN ACT
Amending Title 61 (Prisons and Parole) of the Pennsylvania
Consolidated Statutes, in general administration, providing
for inmate transfer to restricted unit.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 61 of the Pennsylvania Consolidated
Statutes is amended by adding a section to read:
§ 1155. Inmate transfer to restricted unit.
(a) Transfer within institution.--An inmate of any
correctional institution who assaults a correctional facility or
detention facility employee shall be transferred to the
restricted housing unit or equivalent unit of the institution
for a period determined by the chief administrator.
(b) Transfer out of facility.--If a correctional institution
under subsection (a) does not have a restricted housing unit or
equivalent unit, the secretary or the secretary's designee may
transfer an inmate under the provisions of section 1151

(relating to general transfer authorization).
Section 2. Any and all regulations, including the provisions
of 37 Pa. Code § 93.10, are abrogated insofar as they are
inconsistent with this act.
Section 3. This act shall take effect in 60 days.
