AN ACT
Amending Title 18 (Crimes and Offenses) of the Pennsylvania
Consolidated Statutes, in minors, further providing for
purchase, consumption, possession or transportation of liquor
or malt or brewed beverages.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 6308 of Title 18 of the Pennsylvania
Consolidated Statutes is amended by adding subsections to read:
ยง 6308. Purchase, consumption, possession or transportation of
liquor or malt or brewed beverages.

(g) Exception for person receiving medical attention.--A
person shall be immune from prosecution for consumption or
possession under subsection (a) and for a violation of probation
or parole if the person can establish all of the following:
(1) The person came to the attention of law enforcement
as a result of a request for immediate medical attention to
prevent death or serious injury.
(2) The person agrees to undergo a drug and alcohol

assessment within 45 days of the date of the violation of
subsection (a).
(3) The violation of subsection (a) is not a second or
subsequent offense.
(h) Definition.--As used in this section, the term "drug and
alcohol assessment" means an assessment performed by an
accredited addiction services provider or professional to
evaluate an individual's need for any of the following:
(1) Counseling for drug and alcohol use.
(2) Treatment for drug and alcohol addiction.
Section 2. This act shall take effect in 60 days.
