AN ACT
Amending the act of May 1, 1984 (P.L.206, No.43), entitled "An
act providing for safe drinking water; imposing powers and
duties on the Department of Environmental Resources in
relation thereto; and appropriating certain funds," providing
for maximum contaminant levels for perfluorononanoic acid.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of May 1, 1984 (P.L.206, No.43), known as
the Pennsylvania Safe Drinking Water Act, is amended by adding a
section to read:
Section 5.1. Maximum contaminant levels for perfluorononanoic
acid.
(a) General rule.--The Environmental Quality Board shall
adopt a maximum contaminant level of 0.013 μg/l for
perfluorononanoic acid.
(b) Monitoring.-- Monitoring requirements for
perfluorononanoic acid shall be those established under 40 CFR
141.24(f) (relating to organic chemicals, sampling and
analytical requirements) and subsection (c). The following

apply:
(1) The following public water systems shall begin
monitoring within the first quarter of 2019:
(i) A community water system using a groundwater
source serving a population equal to or less than 10,000.
(ii) A noncommunity water system.
(2) The following public water systems shall begin
monitoring within the first quarter of 2020:
(i) A community water system using a surface water
source.
(ii) A community water system serving a population
greater than 10,000.
(3) Notwithstanding the threshold set forth at 40 CFR
141.24(f)(11), the requirement for quarterly monitoring at 40
CFR 141.24(f)(11)(i) shall apply if perfluorononanoic acid is
detected at a level exceeding 0.002 μg/l.
(c) Schedule.--Public water systems that, as provided at 40
CFR 141.23 (relating to inorganic chemical sampling and
analytical requirements) and 141.24, are monitoring for
perfluorononanoic acid at a frequency less than annually shall
monitor once in each Federal three-year compliance period in
accordance with the following schedule:
(1) Year one of the applicable three-year Federal
compliance period:
(i) A community water system using a surface water
source.
(ii) A community water system serving a population
greater than 10,000.
(2) Year two of the applicable three-year Federal
compliance period:

(i) A community water system using a groundwater
source serving a population equal to or less than 10,000.
(ii) (Reserved).
(3) Year three of the applicable three-year Federal
compliance period:
(i) A noncommunity water system.
(ii) (Reserved).
Section 2. This act shall take effect immediately.
