AN ACT
Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
act relating to the public school system, including certain
provisions applicable as well to private and parochial
schools; amending, revising, consolidating and changing the
laws relating thereto," in district superintendents and
assistant district superintendents, providing for district
superintendent contracts.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of March 10, 1949 (P.L.30, No.14), known
as the Public School Code of 1949, is amended by adding a
section to read:
Section 1010. District Superintendent Contracts.--A contract
between a board of school directors and a district
superintendent shall comply with following:
(1) No compensation may be paid to the district
superintendent if the district superintendent separates or
terminates employment with the school district, regardless of
the reason for the separation or termination of employment.
(2) No lump sum payment or any other similar payment for the
remainder of the contract term may be paid to the district

superintendent if the district superintendent separates or
terminates employment with the school district, regardless of
the reason for the separation or termination of employment.
(3) No postemployment health insurance, dental insurance,
vision insurance or payment to cover the expenses of replacement
insurance may be paid to the district superintendent if the
district superintendent separates or terminates employment with
the school district, regardless of the reason for the separation
or termination of employment.
(4) No former district superintendent of the school district
may serve as an acting superintendent or consultant or perform
other services for compensation with the school district.
(5) The district superintendent may not earn, accrue or use
more paid sick leave days, personal leave days or holidays
(6) The district superintendent may not be paid more than
ten thousand dollars ($10,000) annually for combined unused sick
leave days, personal leave days, holidays and vacation days.
(7) If the school district has less than five thousand
(5,000) students, the district superintendent may not be paid
more than twice the salary to which a teacher with a master's
degree and not more than twenty (20) years of experience in the
school district is entitled to receive under the collective
bargaining agreement.
Section 2. This act shall take effect in 60 days.
