AN ACT
Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
act relating to the public school system, including certain
provisions applicable as well to private and parochial
schools; amending, revising, consolidating and changing the
laws relating thereto," in charter schools, providing for
cyber charter accountability commission.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of March 10, 1949 (P.L.30, No.14), known
as the Public School Code of 1949, is amended by adding a
section to read:
Section 1745.1-A. Cyber Charter Accountability Commission.
(a) Establishment.--The Cyber Charter Accountability
Commission is established to study and offer recommendations to
the General Assembly concerning cyber charter schools. The
commission shall consist of the following seven members:
(1) One member appointed by the Governor.
(2) One member appointed by the President pro tempore of
the Senate.

(3) One member appointed by the Minority Leader of the
Senate.
(4) One member appointed by the Speaker of the House of
Representatives.
(5) One member appointed by the Minority Leader of the
House of Representatives.
(6) Two members appointed by the Secretary of Education
as follows:
(i) One member shall be a representative of the
traditional public school community.
(ii) One member shall be a representative of the
charter school system.
(b) Duration of study.--The commission shall issue a report
within 180 days of the commission's first meeting.
(c) Report.--The commission shall study charter cyber
schools and issue a report on the following:
(1) The expulsion of students due to truancy when the
student is failing academically.
(2) The gap between students performing at grade level
within cyber charter schools compared to traditional public
schools.
(3) The disparity between grades and standardized test
scores among cyber charter school students.
(4) The disparity between the cost of cyber charter
schools and brick and mortar schools.
(5) Special education staffing and programs in cyber
charter schools.
(6) Teacher to student ratios within cyber charter
schools.
(d) Period and effect of moratorium.--Notwithstanding any

provision of law to the contrary, beginning on the effective
date of this section and until the completion of the report
under subsection (c), a moratorium is placed on the formation
and approval of new cyber charter schools and the expansion or
increase in enrollment of existing cyber charter schools in
order to provide the General Assembly with sufficient time to
review the completed report and to take appropriate action.
(e) Definitions.--As used in this section, the following
words and phrases shall have the meanings given to them in this
subsection unless the context clearly indicates otherwise:
"Commission." The Cyber Charter Accountability Commission.
Section 2. This act shall take effect in 60 days.
