AN ACT
Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
act relating to the public school system, including certain
provisions applicable as well to private and parochial
schools; amending, revising, consolidating and changing the
laws relating thereto," in pupils and attendance, providing
for expungement of suspension from disciplinary records.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of March 10, 1949 (P.L.30, No.14), known
as the Public School Code of 1949, is amended by adding a
section to read:
Section 1318.1. Expungement of Suspension from Disciplinary
Records.--(a) Notwithstanding any other provision of law to the
contrary, a school district may expunge a suspension imposed
under section 1318 for any infraction as determined by the
school district from a pupil's disciplinary records, including
his or her cumulative disciplinary records.
(b) A school district shall establish policies regarding the
requirements for the expungement of a suspension imposed under

section 1318 from a pupil's disciplinary records.
(c) Until a suspension imposed under section 1318 is
expunged from a pupil's disciplinary records, nothing in this
section shall be construed to eliminate or change a school
district's obligation to notify parents, report offenses
resulting in suspension to the department or otherwise maintain
suspension information of a pupil.
Section 2. This act shall take effect in 60 days.
