AN ACT
Amending Title 18 (Crimes and Offenses) of the Pennsylvania
Consolidated Statutes, in firearms and other dangerous
articles, providing for large capacity firearm magazines
prohibited.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 18 of the Pennsylvania Consolidated
Statutes is amended by adding a section to read:
ยง 6121.1. Large capacity firearm magazines prohibited.
(a) Offenses defined.--
(1) It is unlawful for a person to possess, sell or
manufacture or attempt to possess, sell or manufacture a
large capacity firearm magazine.
(2) It is unlawful for a person to visibly possess a
firearm that includes a large capacity firearm magazine
during the commission of a crime of violence or an offense
under Chapter 31 (relating to sexual offenses).
(b) Grading.--
(1) An offense under subsection (a)(1) shall constitute

a misdemeanor of the third degree.
(2) An offense under subsection (a)(2) shall constitute
a felony of the second degree.
(c) Sentencing.--
(1) A person who is convicted in a court of this
Commonwealth under subsection (a)(2) shall be sentenced to a
minimum term of imprisonment of not less than five years.
(2) Notwithstanding a provision of law to the contrary,
the term of imprisonment may not run concurrently with any
other sentence imposed for an offense arising from the same
criminal act.
(d) Definition.--As used in this section, the term "large
capacity firearm magazine" means a firearm magazine that holds
ten or more rounds of ammunition. The term shall include a
nondetachable magazine and detachable magazine.
Section 2. This act shall take effect in 60 days.
