AN ACT
Amending Title 18 (Crimes and Offenses) of the Pennsylvania
Consolidated Statutes, in burglary and other criminal
intrusion, further providing for the offense of criminal
trespass.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 3503(b)(2) and (b.1)(2) of Title 18 of
the Pennsylvania Consolidated Statutes are amended to read:
ยง 3503. Criminal trespass.

(b) Defiant trespasser.--

(2) (i) Except as provided in paragraph (1)(v), an
offense under this subsection constitutes a misdemeanor
of the third degree if the offender defies an order to
leave personally communicated to him by the owner of the
premises or other authorized person[. An offense under
paragraph (1)(v) constitutes a misdemeanor of the first

degree. Otherwise it is a summary offense.] and is
punishable by imprisonment for a term of not more than
one year and a fine of not less than $500 nor more than
$2,500.
(ii) An offense under paragraph (1)(v) constitutes a
misdemeanor of the first degree and is punishable by
imprisonment for a term of not more than five years and a
fine of not less than $500 nor more than $10,000.
(iii) Otherwise it is a summary offense and is
punishable by imprisonment for a term of not more than 90
days and a fine of not less than $150 nor more than $300.
(b.1) Simple trespasser.--

summary offense[.] and is punishable by imprisonment for a
term of not more than 90 days and a fine of not less than
$150 nor more than $300.

Section 2. This act shall take effect in 60 days.
