AN ACT
Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
act to consolidate, editorially revise, and codify the public
welfare laws of the Commonwealth," in public assistance,
further providing for responsibilities and obligations of
department, applicants and recipients and for eligibility.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Sections 405.3(f) and 432 of the act of June 13,
1967 (P.L.31, No.21), known as the Human Services Code, are
amended by adding paragraphs to read:
Section 405.3. Responsibilities and Obligations of
Department, Applicants and Recipients.--* * *
(f) Penalties shall be imposed on an applicant or recipient
of cash assistance who fails to comply with the obligations set
forth in the agreement of mutual responsibility. Penalties shall
include disqualification from receiving assistance as follows:

(5) Sanctions if a member of the household fails to comply
with the compulsory school attendance requirement under section
1327 of the act of March 10, 1949 (P.L.30, No.14), known as the

Section 432. Eligibility.--Except as hereinafter otherwise
provided, and subject to the rules, regulations, and standards
established by the department, both as to eligibility for
assistance and as to its nature and extent, needy persons of the
classes defined in clauses (1), (2), and (3) shall be eligible
for assistance:

(12) Assistance may not be granted to an applicant or
recipient if a member of the household under sixteen years of
age does not meet the compulsory school attendance requirements
under section 1327 of the act of March 10, 1949 (P.L.30, No.14),
known as the "Public School Code of 1949." The department shall
implement policies in accordance with this paragraph.
Section 2. This act shall take effect in 60 days.
