AN ACT
Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
act to consolidate, editorially revise, and codify the public
welfare laws of the Commonwealth," in public assistance,
further providing for other medical assistance payments.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 443.3(a) of the act of June 13, 1967
(P.L.31, No.21), known as the Human Services Code, is amended by
adding a paragraph to read:
Section 443.3. Other Medical Assistance Payments.--(a)
Payments on behalf of eligible persons shall be made for other
services, as follows:

(4) For special rehabilitation care provided in licensed
nonprofit special rehabilitation hospitals that meet the
licensing requirements of health care facilities under the act
of July 19, 1979 (P.L.130, No.48), known as the "Health Care
Facilities Act." In order to be eligible for payments under this
paragraph, more than ninety percent of the licensed nonprofit

special rehabilitation hospital's resident patients must have a
neurological or neuromuscular diagnosis and severe functional
limitations . Payments under this paragraph shall be made at the
rate for skilled nursing care as specified under 55 Pa. Code ยง
1187.94(2) (relating to peer grouping for price setting), and
the budget adjustment rate shall not exceed ten percent.
Payments under this section shall be made for patients who:
(i) have a neurological or neuromuscular diagnosis; and
(ii) are eligible for medical assistance on the first day of
admission to a licensed nonprofit special rehabilitation
hospital.

Section 2. This act shall take effect in 60 days.
