AN ACT
Amending the act of October 27, 2014 (P.L.2911, No.191),
entitled "An act providing for prescription drug monitoring;
creating the ABC-MAP Board; establishing the Achieving Better
Care by Monitoring All Prescriptions Program; and providing
for unlawful acts and penalties," further providing for
powers and duties of board.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 5 of the act of October 27, 2014
(P.L.2911, No.191), known as the Achieving Better Care by
Monitoring All Prescriptions Program (ABC-MAP) Act, is amended
by adding paragraphs to read:
Section 5. Powers and duties of board.
The board shall have the following powers and duties:

(6) When in the process of making routine technological
updates to the system, integrate the system with prescriber
and dispenser electronic health information systems to
provide enhanced electronic communication for the purpose of
creating streamlined access and reducing human interaction

for functions that can otherwise be handled electronically.
(7) When in the process of making routine technological
updates to the system, develop an automated process within
the system to monitor information entered by prescribers and
dispensers to detect potential abuse and to establish
internal and real-time audits of patients and patient data.
The advisory group shall establish professional criteria to
properly identify and define irregular or potentially abusive
patient behavior. The criteria shall be used to perform the
real-time audit of patient data and produce a real-time alert
for prescribers and dispensers. The board shall submit the
criteria to the Legislative Reference Bureau for publication
as a notice in the Pennsylvania Bulletin. The board shall
solicit public comments for 60 days beginning on the date of
publication of the notice in the Pennsylvania Bulletin. The
board, in collaboration with the advisory group, shall submit
a response to the comments to the department for publication
on the department's publicly accessible Internet website
within 60 days after the expiration of the public comment
period. An alert or report of irregular data may only be
produced at the time when a patient's record is accessed by a
prescriber or dispenser.
Section 2. This act shall take effect in 60 days.
