AN ACT
Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
Statutes, providing for registration of horse-drawn vehicles
and establishing the Horse-Drawn Vehicle Fund.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 75 of the Pennsylvania Consolidated
Statutes is amended by adding a chapter to read:

§ 3601. Definitions.
The following words and phrases when used in this chapter
shall have the meanings given to them in this section unless the
context clearly indicates otherwise:
"Field wagon." A wagon used primarily for field work which

does not typically convey people or property.
"Horse-drawn vehicle." A buggy, trailer or other conveyance
on wheels which is towed behind a horse-drawn vehicle or
nonmotorized vehicle and is used for the purpose of transporting
people or property. The term does not include a field wagon.
§ 3602. Plates required.
(a) Registration required.--Each horse-drawn vehicle
traveling on a public roadway in this Commonwealth must have a
registration plate issued under this chapter.
(b) Fees and duration.--Registration plates shall be valid
for one year. The annual registration fee for a horse-drawn
vehicle is $36.
(c) Plates.--An application for the registration of horse-
drawn vehicles shall be made in accordance with section 1305
(relating to application for registration).
(1) Registration plates shall be metallic, consecutively
numbered and shall prominently display the following:
(i) The county in which the individual applying for
the plate resides.
(ii) The individual's last name.
(iii) The month and year of the date the plate was
issued.
(2) The department shall issue a receipt for each
numbered metallic tag purchased.
(d) Transfer.--Registration plates may only be transferred
between horse-drawn vehicles owned by the same individual.
(e) Display.--The owner of the horse-drawn vehicle shall
permanently affix the numbered tag to the rear of the horse-
drawn vehicle.
§ 3603. Funds.

(a) Establishment of fund.--A special fund is established
within the State Treasury to be known as the Horse-Drawn Vehicle
Fund. Money in the fund is appropriated to the department for
the purposes set forth in this section.
(b) Collection.--The department shall collect fees imposed
under this chapter at the time a horse-drawn vehicle is
registered and shall deposit the money in the Horse-Drawn
Vehicle Fund.
(c) Distribution.--Money paid into the Horse-Drawn Vehicle
Fund shall be distributed by the department to each
participating county in accordance with the amounts collected
from the county. Funds payable to a county under this subsection
shall be used by the county in accordance with subsection (d).
(d) Use of funds.--The plate fee shall be used for the
purpose of road improvements, repairs or replacements due to
damage on the roadways from the wear and tear from the steel
wheels used on horse-drawn buggies.
§ 3604. Penalties.
A person who violates a provision of this chapter commits a
summary offense. Upon conviction of a first offense, a person
shall be sentenced to pay a fine of $50. Upon conviction for a
second or subsequent offense, a person shall be sentenced to pay
a fine not to exceed $200.
Section 2. This act shall take effect in 60 days.
